Nuchi is based in Australia and currently sells to customers in Australia. We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply.

2. What we collect

Depending on how you interact with us, we may collect:

  • your name, email address, phone number, and delivery and billing addresses

  • order, payment and transaction information (card details are handled by our payment providers, not stored by us)

  • your messages, enquiries, feedback and survey or competition entries

  • your marketing preferences and how you interact with our emails

  • how you use our website, such as pages visited and products viewed

  • technical information such as your IP address, browser and device, collected through cookies and similar technologies.

We don’t need sensitive information to process an order. You may choose to tell us about your skin, allergies or health when contacting us, or send photos of a skin reaction as part of a return request. This is health information, which is sensitive information under Australian privacy law. We only collect it with your consent, use it only to respond to your enquiry or request, and delete reaction photos once your request is resolved. Please only share it where it is relevant.

3. How we collect it

We collect information directly from you when you place an order, subscribe, contact us by email, social media or messaging apps such as WhatsApp, enter a promotion (including through entry forms on social media), take part in a survey, or buy from us in person at markets, pop-ups or events. We may also collect information you make publicly available when you tag, mention or message Nuchi on social media, such as your username, profile name and the content you share. We also collect some information automatically through cookies and analytics, and from service providers that help us run our website, process orders and deliver advertising.

You can browse our website without identifying yourself. If you choose not to provide information we need, such as a delivery address, we may not be able to complete your order.

4. How we use it

We use personal information to:

  • process, deliver and support your orders, payments and returns

  • respond to enquiries and provide customer care

  • improve our products, website and customer experience

  • send marketing communications, with your consent

  • measure and improve our advertising

  • prevent fraud and keep our website secure

  • run promotions and customer research

  • meet our legal and regulatory obligations.

We only use personal information for the purpose it was collected, a related purpose you would reasonably expect, or as permitted or required by law.

Our store and payment providers use automated fraud screening, which may result in a payment being declined or an order being held for review. If you think this has happened in error, please contact us and we will review it.

5. Marketing communications and promotions

We use Klaviyo to manage our email communications. If you subscribe, Klaviyo processes your name, email address, purchase information and email interactions so we can send you product news and offers that are relevant to you.

Buying a product does not automatically subscribe you to marketing. You can unsubscribe at any time using the link in any email or by contacting us, and we will action your request within five business days. We will still send essential messages about your orders.

Order-related contact. After a purchase, we may email or message you to ask for feedback or a product review. These messages relate to your order and you can opt out of them at any time.

Promotions and competitions. When you enter a Nuchi promotion, we use your details to run the promotion and contact you if you win. Where the entry form says so, entering also subscribes you to our emails, and you can unsubscribe at any time. We may publish the names of winners as required by the promotion terms or by law. We will only share a winner’s photos, content or feedback with their consent. Each promotion also has its own terms and conditions.

Sharing your content. If you tag or mention Nuchi on social media, we may contact you by direct message or email to ask whether we can share your photo, video or review on our website, social media or marketing. We will only share your content with your permission, we will credit you as agreed, and you can ask us to remove it at any time by contacting us.

6. Cookies, analytics and advertising

Our website uses cookies, pixels and similar technologies to function properly, understand how visitors use it and measure our advertising.

We use the Meta Pixel and Meta Conversions API to measure and improve our advertising on Facebook and Instagram. These tools share information about your activity on our website, such as pages viewed, items added to cart and purchases, together with details you provide at checkout, such as your email address, phone number, name and address. These contact details are hashed (converted into a coded format) before being sent to Meta.

Meta uses this information to match website activity to Meta accounts, help us understand whether our ads are working, and show our ads to people who may be interested in Nuchi. We may also share customer email lists with Meta, in hashed form, to create advertising audiences. Meta handles this information under its own privacy policy.

We may also use Google Ads and Google Analytics to understand how visitors use our website and to measure the performance of our search advertising. Google handles this information under its own privacy policy, and you can manage ad personalisation through your Google account settings.

You can control how Meta uses your information for ads through your Facebook or Instagram ad settings, and you can manage or block cookies through your browser settings. Some website features may not work as well if cookies are disabled.

7. Who we share it with

We do not sell or rent your personal information. We only share it where reasonably necessary to run our business, including with:

  • Shopify, which powers our online store and in-person sales

  • payment providers: Shopify Payments, PayPal and Afterpay

  • Australia Post and other delivery providers

  • Klaviyo, for email communications

  • Meta, Google and other analytics and advertising providers

  • IT, hosting, security and fraud prevention providers

  • professional advisers, such as our accountants and lawyers

  • government agencies, regulators or law enforcement where required or authorised by law

  • anyone else with your consent.

Some of these providers, including Shopify, Klaviyo, Meta and Google, store or process information outside Australia, including in the United States. Where Australian privacy law applies, we take reasonable steps to ensure overseas recipients handle your information appropriately.

8. Keeping your information secure

We take reasonable steps to protect your information from misuse, loss and unauthorised access. This includes limiting access to people who need it, using reputable and secure technology and payment providers, and using appropriate account controls. No system is completely secure, but we take protecting your information seriously.

If a data breach is likely to cause serious harm, we will notify the people affected and the Office of the Australian Information Commissioner (OAIC) where required by law.

9. How long we keep it

We keep personal information only for as long as we need it to provide our products and services, keep business and tax records, resolve disputes and meet our legal obligations. When it is no longer needed, we securely delete or de-identify it.

10. Access, correction and complaints

You can ask us for a copy of the personal information we hold about you, or ask us to correct it if it is inaccurate, incomplete or out of date. We may need to verify your identity first.

If you have a concern about how we have handled your information, please contact us so we can look into it. Let us know what happened and how you would like it resolved.

We aim to respond to requests and complaints within 30 days. If you are not satisfied with our response, you can contact the OAIC at www.oaic.gov.au.

11. Children

Our website and products are intended for adults. We do not knowingly collect personal information from anyone under 18.

12. Other websites, updates and contact

Our website may link to other websites and social media platforms. Their own privacy policies apply to any information they collect.

We may update this policy from time to time. The current version will always be available on our website, with the date it was last updated.

For any privacy question or request, email hello@nuchiskin.com.au.
